Senator Stephen Odey of Cross River North has been sacked by the Court of Appeal sitting in Calabar.
The court also ordered the Independent National Electoral Commission (INEC) to withdraw Odeh’s Certificate of Return.
There has been a legal battle between Stephen Odey’s camp, reportedly backed by the governor, and Jarigbe Agom’s, backed by the PDP core, which had a stand-off with the governor.
The court upheld the ruling by the Abuja High Court, which declared Mr Agom the validly nominated candidate of the PDP in the election.
In her judgment, Justice Chioma Iheme Nwosu of the Appeal Court said Jarigbe Agom Jarigbe was nominated by the party based on the decision of the Abuja High Court, which was upheld by the Supreme Court.
The judge ordered that the Certificate of Return given to Dr Stephen Odey be withdrawn and given to the Appellant, Jarigbe Agom Jarigbe.
